The Personal Information Protection Law represents China’s basic law of the digital age. The law’s sweeping influence reaches all facets of society including the digital tech sector and government institutions. In this lecture, we will explore the legislative intent and internal logic behind the Personal Information Protection Law. The lecture will also analyze the systemic relationship between the law and the Civil Code, the Data Security Law, and the Cyber Security Law. Finally, the lecture will look forward to how the law will be enforced in the future.
對外經濟貿易大學惠園優青學者，兼任中國人民大學金融科技與互聯網安全研究中心副主任、全球經濟治理50人論壇成員、世界數據治理和網絡安全研究聯盟秘書處成員等。 多次參與全國人大法工委、中央網信辦等部門網絡政策法規的起草和論證，在《中國社會科學》、Minnesota Law Review等期刊發表論文60餘篇，他同時還是FT中網、財經網專欄作者。
Associate Professor Xu Ke
Professor Xu is a scholar at Huiyuan University of International Business and Economics and concurrently serves as the deputy director of the Fintech and Internet Security Research Center at Renmin University of China, a member of the Global Economic Governance 50 Forum, and a member of the Secretariat of the World Data Governance and Cyber Security Research Alliance. He has participated in the drafting of network policies and regulations of the Legal Work Committee of the National People's Congress and the Central Cyberspace Administration on several occasions and has participated in several related seminars. He has published more than 60 papers in journals such as "Chinese Social Sciences" and Minnesota Law Review. He is also a columnist at FT China Net and Caijing Net.
中國信息通信研究院互聯網法律研究中心主任，對外經濟貿易大學法學院兼職碩士生導師，中國法學會網絡與信息法學研究會理事，《個人信息保護法》起草組成員。 曾在工業和信息化部政策法規司、中央網信辦法規局長期借調工作，負責相關立法工作。 主要從事電信和互聯網領域立法研究、支撐、起草工作，負責或參與《網絡安全法》《個人信息保護法》《數據安全法》《電信法》《未成年人網絡保護條例》等相關立法起草制定工作。 主持互聯網+法律制度構建、網絡法治體系構建、數據治理等重大課題研究。
Mr. Fang Yu
Fang Yu is the Director of the Internet Law Research Center of the China Academy of Information and Communications Technology, a part-time tutor to LLM students at the School of Law of the University of International Business and Economics, the director of the Network and Information Law Research Society of the Chinese Law Society, and a member of the drafting group of the "Personal Information Protection Law". He has previously worked in the Policy and Regulations Department of the Ministry of Industry and Information Technology and the Central Cyberspace Administration of China and was responsible for related legislative work. He has mainly been engaged with the research, support, and drafting of legislation in the field of telecommunications and the Internet, and has been responsible for and has participated in the drafting and formulation of relevant legislation such as the Cyber Security Law, the Personal Information Protection Law, the Data Security Law, the Telecommunications Law, and the Regulations on the Protection of Minor Networks jobs. He has presided over major research topics such as the internet and legal system construction, network legal system construction, and data governance.
