《反外國制裁法》與中國制裁法律體系

內容簡介:

全國人民代表大會常務委員會於2021年6月10日通過實施《反外國制裁法》。 繼先前發佈的《不可靠實體清單規定》、《阻斷外國法律與措施不當域外適用辦法》，《反外國制裁法》的頒布反映了中國應對西方制裁的法律工具進一步升級。 在本次講座中，中國法研究中心主任張湖月博士將訪問廖詩評教授，探討與中國反制裁措施相關的法律框架、中外制裁體系的比較以及中國的反制裁措施將如何運作的多個實務問題。

Introduction:

On June 10, 2021, the Standing Committee of China’s National People’s Congress passed the Anti-Foreign Sanctions Law. This national law represents a major step forward in China’s legal toolbox in response to foreign sanctions, following the earlier adoption of the Blocking Statutes and Unreliable Entity List. In this webinar, Dr Angela Zhang, Director of the Center for Chinese Law will interview Professor Shiping Liao, who will talk about the legal framework relating to Chinese anti-sanctions measures, the comparison with foreign jurisdictions, as well as how Chinese countermeasures will continue to operate in the future.

廖詩評，北京師範大學法學院教授, 博士生導師, 研究領域為國際爭端解決、國際貿易法、國際投資法、條約法、海洋法、武裝衝突法、國際刑法、國家責任法以及域外管轄和域外適用問題。在《中國法學》和《法學研究》等刊物發表學術論文50多篇。聯合國經社理事會特別諮商地位非政府組織國際法促進中心（CIIL）執行顧問，國際比較法學會域外管轄研究項目中國區國別報告員。 中華人民共和國外交部國際法諮詢委員會委員，司法部國際法諮詢委員會委員。 曾代表中國政府參加多項雙邊和多邊談判，並參加中美第一階段經貿協議談判。 曾參與多項中國涉外立法，作為中國政府代表團成員參加WTO爭端解決機制聽證會。 曾參與處理若干投資仲裁案件。 作為專家證人在國際商會仲裁院、斯德哥爾摩國際仲裁院和新加坡國際仲裁中心的多個國際商事仲裁案件中出庭。

Speaker:

Shiping Liao is a law professor at Beijing Normal University, focusing on several aspects of international dispute settlement, international trade law, international investment law, the law of treaties, the law of the sea, international criminal law, international humanitarian law and extraterritorial jurisdiction, with more than 50 publications in various domestic and international journals. He is now serving as the executive advisor of the Chinese Initiative on International Law (CIIL), an international NGO with special consultation status under the United Nations Economic and Social Council, and a member of the Advisory Board on International Law of the Chinese Ministry of Foreign Affairs and the Ministry of Justice. He has previously participated in several bilateral and international negotiations regarding trade, investment and maritime affairs, and has presented before the World Trade Organization (WTO) dispute settlement proceedings on behalf of the Chinese government, and acted as an expert witness in several international commercial arbitration procedures in the International Commerce Chamber (ICC), the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) and the Singapore International Arbitration Centre (SIAC).
